Legal Question in Real Estate Law in New Jersey

Home Troubles

My Fiancees father passed away leaving no will. Its been around a year and half and me and my fiancee (his Daughter) have lived in and taken care of all the financial aspects of taking care of a house. His wife which hasen't contributed to any of the bills says its her house and we have no rights to it. My Questions arewe have any rights to the House? And She never switched the mortgage over to her name its still in her husbands name would we be in trouble for that since we paid the bills?

Re: Home Troubles

If the wife's name was not on the Deed, the law of intestacy applies. The surviving spouse does not get the entire estate, but a portion goes to children. The formula to calculate the childrens' share is complicated and depends on different factors. You need to consult with an attorney for a better analysis.
