Legal Question in Real Estate Law in New Jersey

House-warming gifts

While dating a now ex-boyfriend I purchased a house by myself. He bought me several items such as a refrigerator, washer, dryer and couches. We broke up in August 2001 and he just contacted me asking for repayment. Am I legally obligated to repay his gifts?

Thank you.

Re: House-warming gifts

I think you may have a good case to say that it was a gift.

Re: House-warming gifts

Please be advised that I have not been retained to represent you and I am basing this response on the limited amount of information supplied. However, the answer to your question is that it depends on a few factors. Gifts given in contemplation of marriage can legally be forced to be returned if the marriage never takes place. If your ex-boyfriend gave you the gifts under any written agreement, the agreement would have to be examined to state what his rights are to a return of the gifts. If they were merely gifts, then you have a right to keep them. If you wish to provide any furhter details, I could better answer your inquiry, but I hope this helped.

GOOD LUCK
