Legal Question in Real Estate Law in New Jersey
Me and my husband both own the house in NJ where we live now (our both names on the house deed). We are separating and my husband agreed to move out and transfer his rights for the house solely to me. What is the best type of deed to use? Do we have to pay transfer fee? Will I be able to sell the house within a year and do not pay capital gain ?

You are getting divorced, and this will affect you in many complicated and important ways. Please go see a divorce attorney and get some assistance.
I do this for a living; I will sit down with you and go over this. No charge for the consultation.
But please, get a lawyer. There is too much money involved, and too much risk to you.
I am a divorce attorney and well as a real estate attorney. I would suggest that you call my office and set up an appointment. I can guide you through the process. Do not try to do this on your own.
I agree with both other authors, and suggest that this can be done simply, without rancor or adversity, but there are ramifications on both sides, so having an attorney assist you might be best.
