Legal Question in Real Estate Law in New Jersey
improperly accused
I am demolishing and rebuilding my home in New Jersey. Prior to demolition I require several permits to be issued by the town. Although all my paperwork is correctly in my permits are being delayed because the town received an anonymous complaint that last year I removed trees without the proper tree removal permit. This is false as I received and have copies of all tree removal permits needed. My question is - since this is causing me construction delays and I am incurring real $ costs because of it - I would like the name of the individual who falsly made these accustions to the town board. Do I have a right to this information? And, do I have any recourse against the town for delaying my construction premits based solely on this individual false claim, particularly since it was the same town official who granted me the tree permits in the first place that is now delaying my demolition / construction permits?

Re: improperly accused
While I understand your anger at the accusation, I doubt that you will be able to move forward more quickly by trying to obtain the name of the person who complained. A good local attorney who handles this type of problem (land use and zoning, municipal law) would be able to assist, along with your engineer or architect.
I do this kind of work, but it is about 45 minutes drive from your area to my office in Hackensack. If you would like me to assist, please call my office. A half hour consultation will be $75.00. You can then decide how you would like to proceed.
