information about expensive repairs withheld by private lake community
In a private lake community, should potential home buyers be informed of fees beyond the yearly dues that will be impossed on the members for repairs to the lakes dam if the lake committee is aware that such additional fees are forth coming?

I am also a member of a private lake community in NJ and we recently had a dam assessment. Most private lake communities have bylaws which govern how additional assessments are to be voted or handled and there usually is a board of trustees for the lake community. Depending upon the bylaws, the voting of additional assessments may not be given to the members but voted only by the board of trustees. If you have not done so already, you may want to inquire how the assessment was determined and whether notices were sent out to the members prior to the assessment notice that you received. Your community may have a payment plan option and you should discuss that with them.
