initial closing date on contract was May 6, 2016 seller agreed to move closing up to March 24th through email through both atttorneys, we found out 2 days before closing there is a lien on the house. our attorney sent time of essence letter to have clean title for closing on april 15th. Can we legally get out of the contract without penalty since the buyer did not disclose he had a lien on the home and could not have title by closing?
