Legal Question in Real Estate Law in New Jersey

Judges Own Rules

1. Is it legal or proper for a judge to excuse himself from the bench on a conflict of interest in a case and allow another judge to rule on the matter and then step back in to overturn what that judge ruled??????

2. If documents show forgery for a home sale in a case while that same home is under contract to a legetimate buyer and the judge does not throw out the forgery incident but allows it to be apart of the sale to the legetimate buyer... Does he cross an ethical line as a judge?????

Re: Judges Own Rules

Your statements are troubling, although I could not begin to be sure of what happened. If you have an attorney assisting you now, then that attorney should be able to answer your questions. You may want to get a 'second opinion' from another attorney, or you may possibly want to fire your attorney and find someone else.

You will want to show ALL of the documents involved, all of the documents concerning the sale and all of the lawsuit documents (pleadings and discovery and all else) to whatever attorney you have review the case.

If you would like, give me a call. My contact information can be obtained from the links below, just click on the Attorney Profile link. Let my secretary know you found me through LawGuru, and I will give you a free initial consultation.

Disclaimer: you can not rely on the advice of an attorney given over the internet. The exact facts of your situation, including facts which you have not mentioned in your question, may completely change the result for your situation.
