Legal Question in Real Estate Law in New Jersey

Can landlord change locks?

Can my landlord just enter my apartment when ever he wants? and can he just change my locks without telling me, I have not paid my rent for May but that is the only time I have missed. And he has not said anything to me about wanting me out.Can he just change the locks on me, with no warning?

This is for my daughter who is a single mother.

Re: Can landlord change locks?

Please be advised that I have not been retained to represent you and I am basing this response on the limited amount of information supplied. However, no - your landlord cannot enter your apartment any time he or she likes and no - your landlord cannot change the locks and keep you out for failing to pay the rent for a month that has not yet ended. Tenants have rights and if you wish to discuss this matter in greater detail, I can be reached at 908-537-7975.

Re: Can landlord change locks?

The short answers are, NO. This sounds like a constructive eviction. Your daughter is a tenant in possession and w/o an order to evict, the LL has no right to lock her out. Given your zip code, if you need legal help, I suggest you call my colleague, Jane Herchenroder, Esq., in Somerville, NJ 908-231-9222

Good Luck,
