Legal Question in Real Estate Law in New Jersey

Landlord Liability in Misplaced CO Detector

I recently had a small gas leak in my apartment that went undetected for nearly a week due to the fact that my landlord had incorrectly mounted the Carbon Monoxide detector near the ceiling as opposed to near the floor as directed by the manufacturer. As a result I became severely ill during that time and according to my doctor would have died soon had I not detected the leak when I had. What is the liability of the landlord?

Re: Landlord Liability in Misplaced CO Detector

Please be advised that I have not been retained to represent you and I am basing this response on the limited amount of information supplied. However, if you could prove that the landlord was negligent in the installation of the detector which led to your illness, the landlord could be held liable for your medical bills and possibly for some pain and suffering. It all depends on what proof you have of the landlord's negligence and what proof you have that the illness was directly related to the negligence. If you would like to discuss this further, I can be reached at 908-537-7975.

GOOD LUCK
