Landlord and tenant problems when unit is sold

In august 1997 we were informed that our rental unit was sold. we were given 30 days to vacate the premises. they had our last month's rent already in escrow. We vacated upon their request. We are currently being suied for the rent of the month's of aug. sept. and oct. we have in their writing a letter form, stating that we are to vacate the property as of sept 15th. We have been relocated for the last 5 months, now they want back rent for the months of Aug Sept. and Oct, and property damage when we no longer reside at the residence. Now we are looking for legal advcse on what to do.

Your question does not indicate if you had a written lease or the dates of the lease term (the beginning and end dates). You also do not indicate if there may have been any damage to the rental property at the time you moved out.

If your lease term still had time to run, you would not have had to move out early just because the property was sold. However, the term may have expired and you may have been on a "month-to-month" lease which required only 30 days notice to end.

Security deposits usually are intended to cover damages to the property caused by the tenant. They are not supposed to be "last month's rent", unless the lease says so.

You should consult with a local attorney to evaluate the facts in your case and advise you of your rights and obligations.
