Legal Question in Real Estate Law in New Jersey
Lien
If I have a lien ( not a tax lien ) but from a bank over 10 years ago, that was paid, but the bank is no longer around, how do I get this removed from my records.
Thank you

Re: Lien
A motion can be filed with the court if you have proof the judgment was satisfied.
Re: Lien
You would need to go to court with proof the lien has been satisfied. A judicial determination could be filed with the land records essentially in place of the release of lien.
Also, does the original lien holder have a successor in interest? There may be records of the satisfaction of the lien.
I strongly recommend that you consult with an attorney immediately so that you can explore your legal rights, obligations, and options. If you wish to discuss retaining my services, contact me at:

Re: Lien
Did the bank go out of business (like Howard Savings) or was it merged into another bank. If the former, you can bring a suit to clear the lien, with proof of payment. If the latter, you can contact the Department of Banking and Insurance to see who the surviving bank was in the merger (some mergers have gone through several changes, but they can tell you who is the current bank). Contact them, verify the payment and they should issue a satisfaction.
