Legal Question in Real Estate Law in New Jersey

Litton

I have a problem with Hud. My husband went into a program with them for our home without my knowledge. He has passed on and now I am 36months behind in my payments. I have been in touch in Hud for three years trying to get them to send me copies of the sign documents and one can seem to find them. The mortgage company I am with now everytime I miss a month or two they put me in foreclosure because of the payments that were not paid. Can someone help me to get these papers and how can I tell HUD that I did not know about my home going into this program.

Re: Litton

Your question raises two issues:

1. The HUD program and how to deal with it;

2. Your mortgage, on which you seem to be regularly missing payments.

You should consult a real estate lawyer in your county to help you sort through these problems. It is possible that HUD recorded a document in the land records that contains the terms of the program and what you have to do to comply with it.

Inevitably, if you continue to be delinquent in your mortgage payments, the mortgage holder will seek to foreclose on the property, even if there were no problem with HUD.

It is better to de4al with these problems before they become more serious. The longer you wait, the harder it will be to try to save your home.
