Loaned money

i loaned my brother and his girl friend a total of 2975.00 to begin a life in a rental.brother died. can i take legal action against the girl friend to get my money? i only have a signed lease with there signatures and the canceled checks made out to my brother. its been a year and i keep hearing from the girlfriend you will get your money, but i have not got anything. what can i do? there was no will or anything of value.

You should file a complaint in small claims court against her. It is relatively simple and as long as you have proof, you should be fine. If you go online to www.nj.gov and to the link for judiciary, there are online instructions on how to file a small claims complaint. Good luck.
