Legal Question in Real Estate Law in New Jersey

losing my water view

i have a single family home in the leonardo section of middletown, n.j. after many upgrades to our home our neighbor has planted shrubs directly in front of our bay window, which looks out onto sandy hook bay, a view we love and was a determining factor in staying in this house and not upgrading to a larger home in another part of town.

my question is do i have any recourse to keep my water view, can these shrubs be removed? can i trim these shrubs?

we do not have a a good relationship with this person.

our home is older than the one in question.

any help in answering these questions will be greatly appreciated.thank you

Re: losing my water view

You do have recourse, but not one that should be discussed in a public forum. Call me if you wish.

Re: losing my water view

The answer to this question will depend on the exact facts of the situation. This includes the location of the property boundary lines, the location of the bushes, the zoning ordinance and other ordinances in town, and the history of the use of your property and his property. You have not necessarily lost out, simply because the bushes are on his property.
