Legal Question in Real Estate Law in New Jersey
I lost half of my income over a year ago and have submitted a hardship/request for loan modification to my mortgage comany for my ARM, interest only loans. Not only do I have an actual hardship, but since my loan is an ARM and interest only (which they no longer offer) I am paying down no principle. I originally purchased my condo with a partner who left after a few months and we were splitting the mortgage. It is difficult to carry on my own and the loans are terrible. We did 80/20 two ARMs with interest rates of 7.5 and 9%! Plus since they are interest only I cannot sell bc I am upside down on the condo.
I am an ideal candidate for modification yet it has been almost ten months with no response. Every time I call they say I should wait for a call from them on the lender's decision. In the mean time I am struggling immensely and feel I am getting no where. There has got to be a better way. Any advice?
I have tried calling along with emailing that goes unanswered. Before I submitted a loan modification package directly to my lender I went through a third party called Hope Now Financial and they turned out to be fraudulent so obviously they did not help me. I tried using NovaDebt a non-profit and they got no where and my lender told me to just work with them directly bc it would be faster and easier and apparently it is not.
I desperately need help and want to avoid foreclosure. I live paycheck to paycheck as it is. I know with all of the new programs there has to be something out there to help me. I purchased back in 2006. Please help.

Unfortunately, it is up to the mortgage company to take action -if any. There are hundreds of home owners in your predicament.
