Maintenance fees

I own a condo and the management company claims that due to some of the owners not paying maintenance fees, we are now thousands of dollars in debt. All owners are now being charged a special assessment fee to cover the debt. And without reimbursement. Is this legal? Liens have been placed on the properties with outstanding maintenance fees.

If this procedure is covered by the By-Laws, it is proper. However, while debt payment can produce additional assessments, the shortfall due to non-payment of maintenance and no provision for reimbusement when arrearages are collected might not be permissable.
