Legal Question in Real Estate Law in New Jersey

Marital Asset after divorce

Can a house be sold without one of the owner being present and/or authorizing the sale of same? Ex-spouse lives in the house, and I will be out of the country for a long period of time.

Hire a lawyer to draft a power of attorney and set a fee for the lawyer to handle all the necessary paperwork and attend the real estate closing for you. My office routinely does this for people at a reasonable fee.

Give your lawyer a power of attorney to sell the house and collect the funds for you. He or she should be able to provide the form.
