Legal Question in Real Estate Law in New Jersey
Misled into buying faulty property
We bought a mediocre apartment with a beautiful new deck. After closing, we found out the developer had never gotten a permit to build the deck and it was a fire hazard. The developer agreed to fix the problem, but this meant cutting off 1/3 of the deck. What can we do? We still want to keep the place, but it really isn't the same with the smaller deck and we feel like we were misled.

Re: Misled into buying faulty property
Your first step is to try to negotiate with the bullder in a resonable way. Get to the boss. Esplain how you feel. Tell him that you expect him to make it right and to compensate you for any loss of value that you have.
If you take a reasonable position, most times, people will be resonsible about it. Let him know that you have legal backup, but, for the moment, you choose not to exersise it. It also helps to find something about which you can be complimentary.
As to the value, understand that it is better for him to give you something back in trade. That is an easier thing for him both economically and emotionally.
If, at the end, you still can't get satisfaction, then we can go to war.
