mortgage broker fraud

while trying to get a mortgage for our home, we came across one mortgage broker who suggested that if we wrote a check ($295-mortgage brokers fee) out to him, he would hold the check and not cash it until a good mortgage quote would be posted and we would give him authorization to cash the check. we wrote out the check and signed an initial agreement with his mortgage firm. as suspected, he cashed the check without our authorization and also did not do any work for us. he is refusing to return the money and now he does not even return our phone calls. are there any organizations out there that we can report him to besides suing him in a small claims court?

You can contact your local or state Consumers Affairs Office and also file a complaint with the local Better Business Bureau. BBB can be found on-line and has several offices throughout the State. Your local CA office may be municipal or county. Perhaps having an attorney write a letter may also help. I do not see why you are unwilling to file a small claims case, in which you can represent yourself, and they may be required to retain an attorney (which would be more expensive than returning your fee.
