Mortgage/House

I have a house w/ girlfriend and 2 kids. Can girlfriend leave and not pay her part of the mortgage?

If she takes the kids with her, that is more than a fair trade, don't you think?

Seriously, you have to go see a lawyer if those kids are yours. You will be looking at child support and college tuition until the little darlings are all grown up.

There are more questions here than answers

Who is on the mortgage? Who is on the Deed? etc

As Mr. Davies said there are many other issues re. kids, child support etc - that are more important than worrying about the girlfriend leaving and not paying rent/mortgage

You do not say if you have any written agreements between you spelling out each of your rights and obligations, who signed the note, what it provides, and whose children they are, yours or just hers. Most real estate litigation happens in these situations, which is why I insist that my clients put it all in writing. In most situations, without something in writing, either party can be held responsible for the entire mortgage, so you have a great exposure. If you need assistance, contact me directly.
