Legal Question in Real Estate Law in New Jersey

My mother did sell her house to my brother, deed and all. He did take out an entirely new mortgage. He has the house on the market right now. My mother doesn't want to move out. She couldn't pay the mortgage and my brother offered to buy the house so she wouldn't lose it. Now, she will lose the house.

A lawyer suggested another family member taking over the house. There isn't anybody with any money. Another suggestion was for my mother to get a reverse mortgage on it once she gets it back. That is exactly what she would like to do. But, my brother won't just give it back to her. He wants the money he put out for the house. He wants it yesterday.

My mother is in her 80s and doesn't want to move. She is VERY upset.

Is there any way she can stop the sale or anything at all she could do? Is there any elderlaw that would cover this situation?

This response is not legal advice, since I do not have all of the information that would be required, and I do not have a representation agreement with you.

* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.

* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.
