Legal Question in Real Estate Law in New Jersey

I am moving out of an apartment in NJ after 8 years, and since there has not been a lease since 05 I have sent the landlord a 30 certify notice. In the notice I ask for information on the security deposit and to apply it to the last months rent.

I received from the landlord a hand deliver letter, in which I am advise that it is illegal to use the security deposit, and enclose a photo copy of a small claims law suit application from the landlord against me for October's rent (letter received on Sep 28).

My reason for wanting to use the security deposit is because I know the at least one month was giving ($1350) But I never receive any information on it, such as bank deposit, yearly statement with accrue interest. I've ask the landlord on several occasions for this information and more recently in the 30 notice, but still no information. I cannot find my original lease of 2001 and the banks statements only go back to 7 years. I fear the landlord never deposited that money and that 8yrs later he himself does not know with certainty how much is owe to me. My fear is that this goes to court and that this somehow can affect my credit, I am in the process of buying a house and need my credit intact.
