Legal Question in Real Estate Law in New Jersey

Names on house deed

I have been married for 12 years and have two young children. Our house is in my husband's name. We may be divorcing. Should my name be added to the deed? Would that provide me protection or more debt? We are having trouble making our mortgage payments now. Thank you for any guidance you can provide.

Re: Names on house deed

Please do not go through a do-it-yourself divorce. You and your children need to know your rights and protect them.

If you and your husband together are having difficulty with the mortgage payments, that will not change, no matter whose name is on the deed.

Title to a family home can be changed as part of a divorce settlement. You should have a family lawyer representing you, and be sure to tell her or him to include negotiations for the house.
