Legal Question in Real Estate Law in New Jersey
Neighbor cut our trees
Our neighbor had a tree service cut about 40 trees on her property. When we came home from work that day we found about 5 or 6 of our trees cut down too. These trees were very big and served as a privacy wall. My neighbor told me the tree guy is responsible. But he wont take responsibility and replant what he took down. Who is ultimately responsible for cutting our trees down?

Re: Neighbor cut our trees
You don't need to be concerned about deciding whether your neighbor or the tree company is responsible. Sue them both and let the court decide.
Be sure to collect your evidence soon. You will have to show that the trees were cut by the tree company and that they were on your property. Damages will be influenced by the character of the trees. So, some photos prior to the cutting will help.
