Legal Question in Real Estate Law in New Jersey

My neighbor has a large oak tree on his property. It has not been maintained i.e. trimmed in some time. The branches have been falling on my property, narrowly missing my car.

If the tree does damage to my house or car - who's responsible?

You will want to take some steps, like writing a clear letter (and keeping a copy) telling your neighbor about the problem and demanding that the neighbor trim the tree. That will give you a stronger basis for claiming (after a branch falls on your car!) that the neighbor should have trimmed it. If the tree is dangerous, the town may force them to trim it.
