Legal Question in Real Estate Law in New Jersey

Oil tank removed, covered by insurance 6.5 years ago. Property, sidewalk and sprinkler system ruined by large machinery driving on lawn without boards. Suing oil company to restore property. Got court date, had to change as I am at a medical conference for my job out of state that week. Sent notice to oil company as directed, they simply returned it to me. I was told I did not have to send certified. Are they responsible for finding the new date? If they show up on the wrong day am I responsible? During this time, my husband, who was taking care of this, passed away very unexpectedly. I am really not 100% sure what to do, as a local attorney advised me to represent myself, since I am a only asking for repairs about $3-4000.00.
