Legal Question in Real Estate Law in New Jersey

My options?

I leased an apartment on 2nd floor and landlord lives on 1st floor. Housing officer inspects & says apartment can't be rented because it is one family house. I asked landlord to return security deposit. He agrees but asks me to move out in 2 days which I can't because I don't get time off from work. He asked me to leave in 2 days or forget about the money. What are my options?

He illegally rented the apartment, so you should not pay any penalty or forfeit your deposit for not immediately moving out. If anything, you could sue him for your moving expenses. Take a reasonable time to find a new apartment and be aware you can only be forced out by a Court Order, which would require him to file suit and serve you with the Complaint.
