Legal Question in Real Estate Law in New Jersey
I am looking to see if a partition action makes sense in my case. I am divorced out of another state but my ex and I own a home in NJ. The divorce decree stipulates that we equally share the property and will need to agree when to sell it. I have wanted to sell the property for years now but my ex-husband refuses. We lose money on the home every month because our renters do not cover the mortgage. I simply cannot afford to be in the house any longer. Can I file a Partition Action or does my divorce decree from Colorado prevent me from doing so?
