Legal Question in Real Estate Law in New Jersey

Property: Historic District.

Has anyone challenged the right of unelected Historic Preservation Committees to refuse renovations that are otherwise approved by zoning boards, or to require increased expenditures beyond the property owners abilities, even though they have no professional training in these matters?

Frequently. Sometimes the committee wins and sometimes the property owner wins. It depends on what is involved in the issue.

If you have a specific issue, you should consult with your lawyer or a lawyer who practices in the area of municipal land use. In your area, my choice would be David Serlin, Esq. of Moorestown.
