Re: property in my name separated need quitclaim deed
You do not say if you owned the house prior to the marriage, or just purchased it after you were married. This is important as equitable distribution on divorce does not apply to premarital assets unless they were converted to marital assets. Keeping the ownership separate may exempt it from any claims. However, it is possible that if the value appreciated during the marriage, that some claim be made based upon the appreciation. You do not say how long you were married, the age of the child, etc. These issues also have to be dealt with as part of equitable distribution, child support, alimony and/or maintenance. I suggest you contact a good local matrimonial attorney to assist you. If you need a recommendation, contact the county bar association where you live and use their referral service.
