Legal Question in Real Estate Law in New Jersey

I just purchased a condo unit in NJ and the seller (and seller's broker) did not disclose very significant noise issues from a restaurant across the street on weekend nights past midnight - significant enough that there have been lawsuits and passed/redacted ordinances against the restaurant. However, there are no issues during the day. This issue is well known by everyone who lives in the condo building.

In separate instances, I had verbally asked the selling broker whether there were noise issues and the sellers whether they had had any issues while living there and their answers were both "No". There is nothing in writing.

Can I rescind the purchase or sue for damages?

I assume you signed a contract for purchase. When did you sign? how much of a deposit did you make? any witness to your questioning of the owner? Are there any disclosures from the seller? In other words, there MAY be a basis to get out, or a way to negotiate a termination of the contract, it is a factual issue, but there is no clear answer.

Buying a home is a BIG deal, so bite the bullet and get a consult with an atty!
