Legal Question in Real Estate Law in New Jersey

Purchasing a home without my spouse knowing

My husband left me over 2 years ago. We both currently live separately with relatives in the state of NJ. We have not reconciled or divorced yet and I am in the process of buying a home. I want to avoid him having any interest in the home that I buy. Should I get a quitclaim deed from him to me, even though he is not the one who's name is on the title (I am)? My settlement date is less than a month away and he has no idea about the purchase yet.

Re: Purchasing a home without my spouse knowing

You should think about hiring a lawyer. In northern NJ, a lawyer is required at settlement, in the southern part of the State it is just a recommendation.

To be on the safe side, you should talk this out with counsel, and maybe bring counsel to the settlement. In my experience, I can save you from a lot of grey hair and headaches if you let me advise you first (and in some cases I can even save you some money) rather than let the problem grow.
