Legal Question in Real Estate Law in New Jersey

Randy has a judgment against ex-wife. Ex and boyfriend purchased property together in NJ. Both names were on mortgage. Randy placed a lien on property. The next year, it was re-financed with only her name on mortgage. Now he's being told it will go in a Short-Sale, because of foreclosure. Boyfriend died, and has about 5 judgments on him. None had liens on property, but are from NJ DMV, Dept Taxation & Dept of Labor. Her attorney has ask how much would he take for a release of lien. Told him $8000 (Lien is for $26,000) Lawyer says they don't have much money to work with. Re-fi was for $374,000. In February property had been listed for $216,000. Who should be priority receiving funds, liens or judgments? He doesn't want the judgment released, only the lien.

you can not get an answer to this question without a lot more information. I would want to see a title search, and then tell you what priority your claim has.
