Legal Question in Real Estate Law in New Jersey
Real Estate Closing: Attorney holding portion of my money
I sold my home on 6/28/02. Today is 08/09/02 and I still haven't received all of the money owed to me from the closing. The Attorney has $750 that is owed to me. I call and no one responds. I am ready to go to court. What can I sue for besides the $750 owed to me? Someone should pay for their lack of accountability.

Re: Improper retention of funds by attorney
The first thing you want to do is leave a message with him or his office that if you do not receive your money within three days that you will be filing a complaint with the Office of Attorney Ethics. Then, if you do not receive the money, call them at 609-530-4008. Tell them your problem and they will give you the procedure to follow. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. If you have any questions whatsoever about this advice or the procedure to follow, you may want to contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. Mention Law Guru and your first consultation is free. Good luck!
