Legal Question in Real Estate Law in New Jersey
The Real Estate company had an exclusive right to lease the subject property. The owner went behind the broker's back and leased the property himself during the listing period. Can the broker sue for Treble damages? The owner states there is no lease, that he owes no money even though the tenant has occupied the premises for over a year.

If the realtor had an 'exclusive', and the property was leased during that listing contract period, then the realtor should win.
The realtor should talk to a lawyer, and probably sue.
