Dad died in 1986. No will. Mom has been paying taxes(up to date) since then. She wants to sell. Her name is not on deed. No probate.

The good news is your Mom will have no trouble selling the house. The bad news is she may have to apply for administration at the Surrogate Court where your father lived. Are you certain your Mom was not on the Deed? You also need to check since she may have been added at a later time.

Trouble. Estate needs to be probated, especially since there is no will and your mother's name is not on the will. See an attorney asap.

As per common law she has the right to sell. We need the death certificate and make sure estate is probated, but no big deal. I can help please call my office at 201/646/9600.
