Legal Question in Real Estate Law in New Jersey

name used in real estate property

I want to know if I can sue my brother in law and my sister for emotional distress in regards to not paying the rent causing the house under my name to be foreclosed. They convinced me to put my name in the house that they're occupying since being sold by the tenant. I know that with the amount of money I'm making I am not going to be qualified, but then he said that his friend who is in a mortgage business will approve no matter what. My brother in law promised that he will take care of the mortgage, but he hasn't not even once. I had the house June last year, now it in foreclosure and my credit is ruin. I want to sue both my sister and my brother in law for them to realize that this thing they do to people is a crime. They are actually trying to get somebody again to take over the house and do the same thing with the same underwriter. And according to my understanding the reason why the underwriter added more value to it because he gets a cut from it. The house was being sold for $360,000 but then he gave a loan for $430,000 and the seller supposed to give back the diff of at least $58,000 (closing cost adjusted) but then they only gave back $30,000 which was used to the business that they are supposed to running. PLEASE HELP

Re: name used in real estate property

I would suggest that you report them to your local law enforcement agency, as well as to the lender (not the mortgage broker, but the company that actually loaned the money). They are usually interested in people who commit crimes of this kind. You might also want to report them to your title insurance company (from when you took title to the property).
