Legal Question in Real Estate Law in New Jersey

realestate

My wife is 1/4 owner in a two family house, her name is on the deed. Our will states that when either of us dies all posessions go to the surviving partner. What will happen if my wife should pass away.

Re: realestate

You did not indicate if the names of the other 3/4 owners' are on the deed too. If their names are not, unless there is some kind of partners or co-owners' agreement among your wife and the other owners, the entire house would be part of her estate.

You and her other heirs would inherit her interest in that house. In what proportion and if at all depend on whether she has a will stating to whom that interest goes, or if she doesn't have a will, the proportion in which the surviving spouse and children will share in her interest.
