Legal Question in Real Estate Law in New Jersey

remove my name, relocating

I own a house with my mother. I am on the deed and the mortgage. I recently got engaged and will be moving to the Midwest. How do I get my name removed from all of the household bills, the deed and the mortgage. She plans on selling the house once I move but I'd like my name free and clear so I can purchase another residence. Any help would be appreciated. Thanks.

Getting "off the deed" is easy - A quit claim deed could be prepared and filed. Getting "off the mortgage" is a larger issue because you would need the lender to agree to release you (which is unlikely for most lenders) or have your mom refinance the property. If she's going to sell the property, refinancing now does not make financial sense. The best bet seems to be to get the property sold as soon as possible.
