Legal Question in Real Estate Law in New Jersey

what is my responsibility toward mortgage after sale of house

I was divorced and the terms of the divorce was my ex got the house for $1. My name is still on mortgage. Now I found out my ex is selling the house. What is my responsibility toward mortgage when it is sold? Do I have to sign mortgage papers or is my participation not necessary.

Re: what is my responsibility toward mortgage after sale of house

You do not say what the transfer terms were in connection with the mortgage; i.e. who became responsible for the mortgage when the house was transferred? If your "x" became responsible for the mortgage payments when the house was transferred, you have no responsibility. On the sale the mortgage would be paid off and you would be relieved from further liability. You would not need to join in the new Deed. If you retained responsibility for the mortgage, you would be responsible for the payoff. Send me an e-mail if you need clarification, or call me at 973-377-3313.
