Legal Question in Real Estate Law in New Jersey
We are scheduled to close a home in Bergen County, NJ in two days. The seller has requested that they occupy the home for another two weeks before they are able to move out. We've agreed to allow it as long as they pay for the carrying costs of our mortgage. We have not come to terms. They are saying today that they want to stay without paying any use fees whatsoever - justifying it based on a repair credit that was given to us and some unexpected repairs that they had to do at their discretion. Allowing them to stay is incurring three costs - 1) the mortgage, taxes, and utilities for the home.; 2) the cost of our rented apartment while we wait; and 3) the costs of maintaining our mortgage rate. Their lawyer is basically taunting us to issue a "time is of the essence letter" which would give them another ten days to close and stick us with the bill for items #2 and #3. Is there anything we can do to compel them to close and take these costs? Can we walk?
