Legal Question in Real Estate Law in New Jersey

Security Deposit Reimbursement

I recently received notification that out of the $1850 security deposit we paid they are trying to charge an $800 fee for painting. Now keep in mind that there was no real paint damage to the unit beyond normal wear and tear. Nor did we receive any documentation prior to move out that a fee like that could be assessed or if so, how much they would be entitled to. I just wanted to know if this was a charge we could dispute and on what grounds.

Re: Security Deposit Reimbursement

You are only responsible for damage beyond normal wear and tear. If you believe that you are being charged more than that, make a written demand of the landlord that the balance of the security deposit be refunded. If that doesn't happen, you can sue to have it returned.
