Security Deposit

I signed an apartment lease from someone who was subletting to me (im not sure if she was allowed to or not) and the lease stated that it was only for ONE month and I signed it in January 04. The lease stated that I had to give 60 day notice prior to moving out. I gave her 40 day notice and she is stating that she will not give me any of my deposit back because I only gave her 40 days. I didn't even think the lease was binding if it was only for one month. Is this legal? She is refusing to pay me my money. should I find out who she is renting from to see if she is even allowed to sublet because I don't think she is.

I would need more information. There is a security deposit law that may apply to your situation. The lease would have to be reviewed as well. Did you have a lease from the original landlord?
