Legal Question in Real Estate Law in New Jersey

In the State of New Jersey (Roxbury Twp.) How many years would it take ,when someone is maintaining a strip of our property before they can claim it as their own. also using it as though it were their own.

The simple answer is 20 years. N.J.S.A. 2A:14-6. However, the simple answer is not always easy to apply. There are also some legislative proposals to extend the period for woodlands, uncultivated land, and tidal land. The area of adverse possession is also technically complex. The possession must be continuous, open, adverse, and notorious (obvious). It can be defeated by the simple expedient of giving the possessor permission which defeats the "adverseness" of the possession. In short, before you rely on a claim of adverse possession either way, consult a lawyer who can review the specifics.
