Legal Question in Real Estate Law in New Jersey

Tenant despute

I rented a 1 family house and my rent is paid by the section 8 rental assistance program.

The house has a driveway with a backyard and the owner wants four of my vehicles from the parking facilities of the house through the driveway removed. He wrote a letter to the section 8 program stating he wanted the cars removed from the property. He is always in and out of the backyard stating he has the right to go in and out as he pleases. The lease does not State whether or not we have the right to use this driveway. What can I do. Please be aware that this is a one family dwelling and only I live on this property with my family. What are my rights?

Re: Tenant despute

I cannot give you a definite answer without reviewing your lease. However, it would seem that your rental of the premises, with the prompt payment of rent, gives you the right to peaceful possession of the entire premises. That being the case, it would appear that the landlord is violating this right. Further, as long as the cars are legally parked on the premises and you are not in violation of any laws concerning the registration of vehicles, or local ordinances concerning abandoned or junk vehicles, you should be allowed to have them on the premises. Again, this answer may be very different depending on the terms of your lease. Good luck!
