Legal Question in Real Estate Law in New Jersey
Tenant's rights
renting in 3br, 2b apt for 10 yrs. appx 4 wks ago, there was a leak from our main bath to landlord's bath. He came up and had to break a tile to fix it. On Thanksgiving day, my grandson went to bathroom & unfortunately toilet overflowed. We did not know about it right away. Up came landlord to say his bath had water from ours. He was understandably upset, but it wasn't done intentionally. He told to to ''get out''. My grandson (7yr) cried his heart out as he thinks its his fault. He told us we have till 1/1/08. What if we dont find something we can afford by that time. I've called a few places & seen one - can't afford $1800. Need 3br, 2b for 4 adults & 1 child. Do we have any rights to stay an extra month if need be. Couldn't be worst time with holidays as well. Thank you! Suzie

Re: Tenant's rights
You have rights, and with a little help from a lawyer you will be able to work things out a lot, a lot better.
Your rights will vary depending on what type of house (2 family with you and landlord gives landlord more rights), and other things.
Do not just move out; landlord has no right to order you to leave. landlord will be severely punished if he illegally locks you out of the apartment.
