Tenent/Landlord Problem
A year and a half ago, my brother, sister and I decided to swap houses after our father’s death (mom’s also dead). My sister, her husband and the kids took our dad’s house, my brother and I took their house. We’ve been paying not only the rent but all the bills for their house including the bill they said they would take care of. and never did. Now they are having serious marriage difficulties and my sister is threatening to sell the house out from under us if we don’t get a mortgage. With the market as bad as it is, my brother and I are very hesitant to go for a mortgage. About a month ago, my brother-in-law decided to evict us during one of their fights then took it back. There is no lease because he felt we didn’t need one since it was between family. Right now the house is half packed, half not since we don’t know what’s going to happen next. Also because the house is still in my brother-in-law’s name my sister feels it gives her the right to come and go at the house as she pleases and do what she wants to the house (aka..painting, ripping up tiles landscaping) because she’s planning on selling it. My question is what rights do my brother and I have as tenants? We are ready to just pick up and move out.

Who's name is you parents' house in? You should sit down with an attorney and bring any papers you have concerning you father's estate, copies of both deeds, and any letters or other writings about the exchange. Call for an appointment and I will help you straighten all this out.

You have a first-class mess on your hands. You need to sit down with an attorney, and all of the documents showing ownership to the houses and also the documents in your father's Estate. You need a lawyer's help to stop your brother in law and sister from harming you.
