Legal Question in Real Estate Law in New Jersey

Title Company Asking for Refund of Money

I recently closed on a new home using the title company as my agent. I have a real estate license in NJ and a comission was to be sent to my broker who would pay me my portion of the comission. Now the title company is coming back to me for $5000. so that they can pay my broker that amount for the comission. My closing paperwork shows a $5000. credit for a Decorator Selection. They are now saying that was the comission that should have gone to the broker. Do they have the right to come back to me now after we've closed and expect me to come up with that money to pay for their mistake?

Re: Title Company Asking for Refund of Money

As a realtor, you probably have attended many settlements and therefore felt comfortable without an attorney....however, there is generally a form you sign at settlement obligating you to correct errors.

I'd be happy to consult with you and review the paperwork for a modest charge. At that point we can decide the best course of action.
