Legal Question in Real Estate Law in New Jersey

Town prohibits heat to be installed in my home, what can I do?

I purchased a home down the Jersey Shore and the town is prohibiting me from putting heat in my home. Is this permissable? There is significant dampness in my home. I have concerns about mold and mildew. There already exists mold under my kitchen cabinets. I have young children. I do not use this home year round , only in the summer. Isn't there a code of construction for the state which would overide the town when addressing health issues , my concern being mold from the dampness. The property is considered a non conforming lot, it is a condominium. There are 2 structures on one lot, a front house and a back house. PLEASE HELP......

You have an ugly situation. I suggest you have an attorney look carefully at all paperwork (your application for a permit to put in the furnace, their rejection) and also look at the town's laws, including the zoning ordinance and the building code.

Make sure that the attorney you use is very experienced in zoning and construction; ask how many times in the last couple years the attorney appeared before any municipal plan boards or zoning boards of adjustment, and how many construction disputes the attorney handled.

I am not near you, but would be willing to assist if you like. I am in northern New Jersey. The consultation may be free, speak to me and I will let you know ahead of time. I will do what I can to help you out.

The situation that you describe is uncommon and it is probably influenced by the nature and condition of the property as well as the local regulations. I would be happy to look at the documentation that you have so that I can be more specific. My contact information appears in the links associated with this reply.
