Legal Question in Real Estate Law in New Jersey

Unable to sell home. Potential buyers are unable to obtain title insurance, because the home partially sits on railroad property. The railroad refuses to grant an "encroachment agreement" which I have offered to pay for, claiming they need that property. The home is very old (built in 1890)

Is there a way out of this without tearing the home down completely and rebuilding?

Matters related to real property are governed by State law which varies from state to state. In this case, there are overtones of federal grants of land and land rights to the railroads. You should seek local counsel to help you.
